This policy applies to the http://mentegram.com website (“Website”) and the Services offered by Mentegram, Inc., a Delaware corporation (“Mentegram”, the “Company”, “Us”, “We”, “Our”). This policy describes how Mentegram collects and uses personally identifiable information (“personal information”) you provide on our Website and through our software and mobile applications (the “Platforms”). The use of information collected through our Service shall be limited to the purposes of providing the Service for which the Customer has engaged Mentegram or any other purposes stated in this policy. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. This policy agreement does not pertain to protected health information entered by registered users. Our Terms of Service agreement, found at https://mentegram.com/terms/ defines the privacy of patient information for the treatment clients (“Client” or “Clients”) and treatment providers (Provider” or “Providers”), both comprising the users and Customers (“Customer” or “Customers”) of our tele-health services (“Service” or “Services”). When you use any of the Platforms, you agree to the terms in this policy.

Information ownership and retention

Owner of the Record

The Provider (healthcare provider) is the legal owner of the medical records created and generated from treatment (including but not limited by the use of the Mentegram Services). Providers must comply with any medical records release requests by a Client or legally authorized entity. Providers must maintain patient records as required by law within their jurisdiction and make available any records if requested by a Client. No records shall ever be released without a written release from the Client or Client’s legally authorized agent. Mentegram has no control over such medical records.

If the data Client seeks were not shared with any Provider, Mentegram is the owner of the record, and any requests for data should be directed to [email protected].

Service Provider Data Retention

Mentegram will retain personal data we process on behalf of our Customers for as long as needed to provide Services to our Customer. Mentegram will retain and use this personal information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements. Data will be retained in accordance with our policies and will be deleted or destroyed without notice in a manner consistent with such policies.

The categories of Personal Information we collect

When you visit or use the Platforms, we may collect information from you. Some of it may be personal information. This information can include search history, IP address, screen resolution, browser used, operating system and settings, access times and referring URL. If you are using a mobile device, we may also collect data that identifies your device, your settings and your location.

We collect different information from Providers and Clients.

If you are a Provider, we collect the following information from you:

  • Contact Information such as name, email address, mailing address, phone number
  • Billing Information such as transaction ID’s when you pay your bill through a payment gateway (e.g. Paypal)
  • Unique Identifiers such as user name, account number, password
  • We may collect information about the location from which you access our Services

We also collect the following information from you

  • Information about your business such as company name and license number

If you are a Client, we collect the following information from you:

  • Contact information such as name, email address, phone number as provided by your Provider
  • Your responses to, and interactions with our Website, web or mobile application(s) on your computer, phone or device
  • Location information

We also collect the following information from you

  • Any notes, comments or other information about your interaction with your treatment provider as provided by your provider

If you give us personal information, you are telling us that the information is true, accurate, complete and current. You are also telling us that you have the authorization to provide it to us.

How we collect your Personal Information

We collect your personal information directly from Clients and Providers. For example, when you provide us your personal information when you use our Platforms, answer our questions, engage us to provide Services or open an account with us.

We also collect your personal information passively. For example, we collect information about you over time and across different websites when you visit or use our Platforms. We also use tracking tools like cookies and beacons.

Why we use your Personal Information

We use your personal information to provide you our Services, to improve our Platforms and Services, to better understand the users of our Platforms and Services, to protect our property and to prevent damage to them.

If you are a Provider we also use your personal information to:

  • Fulfill your order
  • Send you an order confirmation
  • Send you requested product or Service information
  • Send product updates
  • Respond to customer service requests
  • Administer your account
  • Send you a newsletter and marketing communications
  • Respond to your questions and concerns
  • Improve our Website and marketing efforts

If you are a Client we also use your personal information to:

  • send your responses from our mobile application(s) to your selected Provider, when sharing with Provider(s) is enabled
  • Analyze, present, and otherwise process your information for you and/or your Provider
  • Build an algorithmic understanding of your behavior for the use of providing information about you to you and your Provider
  • Administer, build, and improve our products and Service
  • Research our Services, the use of our Services, and other related uses.

User access and choice

If your personal information changes, or if you no longer desire our Service, you may correct, update, amend, delete/remove it by emailing our Customer Support at [email protected] If you are a Provider, you can perform these changes by logging into your Mentegram Provider account. We will respond to your request within 30 days. We will retain your information for as long as your account is active or as needed to provide you Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Opt-out Preferences

If you are a Provider, receiving emails from our Website is part of our Service. If you no longer wish to receive these emails, you may opt out of them by canceling your account. When you sign up for a Mentegram account we will use your name and email address to send you newsletters. If you no longer wish to receive these emails you may follow the unsubscribe instructions contained in the email you receive or by emailing us at [email protected].

If you are a Client, we will send you only emails on behalf of your Provider, or when contacted by you directly.

How we share your Personal Information

We may share your personal information with our corporate affiliates and with third parties for our legitimate business purposes as permitted by law. For example, we may share your personal information with suppliers who perform services on our behalf and have agreed in writing to protect and not further disclose your information.  We do not sell your personal information to third parties.

If you engage us for Services through one of our Platforms, we may share your personal information with the payment service providers and the vendors needed to provide the Services. This can include credit card companies and state agencies. These third parties will process your personal information as data controllers in accordance with their own privacy policies.

We may also share your information as otherwise described to you at the time of collection.

If the Company itself (or part of its business) is sold or otherwise changes control, the new owners would have access to your personal information for the uses set out herein.

If you provide us a review of your experience with us, you authorize us to publish it on all our Platforms. You also authorize us to aggregate it with other reviews.

We may disclose personal information if required by law, for example to law enforcement or other authorities. This includes court orders, subpoenas and orders arising from legal processes, and administrative or criminal investigations. We may also disclose your personal information if the disclosure is necessary for the prevention, detection or prosecution of criminal acts or to prevent other damage, or in response to a legal action or to enforce our rights and claims. We may also disclose personal information to any other third party with your prior consent to do so.

We may also share anonymous aggregated usage information with others.

How we store and protect your Personal Information

The security of your personal information is important to us.  Mentegram has a security program intended to keep the personal information stored in our systems protected from unauthorized access and misuse. Our systems are configured with data encryption, or scrambling technologies and firewalls constructed to industry standards. We also use Secure Socket Layer (SSL) technology that protects the data you send over the Internet.

Personal information may only be accessed by persons within our organizations, or our third party suppliers, who require such access to carry out the uses indicated in this policy.

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, we cannot guarantee its absolute security. Other Websites

If you click through to third party websites or other platforms, the Company’s privacy policy does not apply. This Website contains links to other sites that are not owned or controlled by Mentegram. Please be aware that we, Mentegram, are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our site and to read the privacy statements of each and every website that collects personally identifiable information. This privacy policy applies only to information collected by this Website.

Children

The Company does not knowingly collect personal information from minors without the consent of a parent or legal guardian. If we become aware that a minor is attempting to submit personal information, we will remove this information from our records to the extent applicable law allows. The Service can be used by Providers to serve children age 3 and above (Clients). However, the Providers willing to use the Services with Clients who have not reached the age of maturity in their country must obtain the permission from the Client’s parent or legal guardian, in accordance with all local laws, and professional rules. If you register as the parent or legal guardian on behalf of a minor Client, you will be fully responsible for complying with our Terms and our Privacy Policy. If you are the parent or legal guardian of a minor who has given us personal information, please contact us so we can delete it.

Cookies and other tracking tools

The Company uses tracking tools such as cookies and beacons.

We (or our suppliers or partners) use several common tracking tools. We use these tools to collect usage and demographic information about you over time and across different websites when you use any of our Platforms. We also have third parties (e.g. advertisers) that collect personal information this way. Tools we use may include browser cookies. Your browser will store these cookies on your computer in a small file.

We and our advertising partners may also use web beacons (single pixel GIF images). These web beacons are placed in the code of a Webpage or an email newsletter.

The Company uses tracking tools for the following purposes:

Our Website may include Social Media Features, such as the Facebook Like button and Widgets, such as the Share this button or interactive mini-programs that run on our Website. These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. It is the responsibility of the Providers to notify their Clients of material changes to this policy.

Accessing and rectifying your Personal Information

You are entitled at any time to obtain information about all your personal information that we store, in accordance with applicable law and without any fee. However, in exceptional cases we ask you to pay reasonable fee before we provide the information if permitted by applicable law. We may request proof of your identity before providing this information. We may not be able to allow you to access certain personal information in some cases. For example if your personal information is connected with personal information of other persons, or for legal reasons. In such cases we will provide you with an explanation why you cannot obtain this information. You can also withdraw your consent to the use of your personal information at any time by contacting us at the address below. You can demand deletion or rectification of your personal information, however, statutory provisions, especially those affecting the Company’s accounting, processing of claims, and mandatory data retention, may prohibit deletion or anonymization.
